Identification du prestataire<\/strong><\/p>\n\n\n\n<p>1000Deeg S\u00e0rl-S<\/p>\n\n\n\n<p>Si\u00e8ge social : 5,rue Renert 7223 Bereldange<\/p>\n\n\n\n<p>RCS Luxembourg : <em>B288457<\/em><\/p>\n\n\n\n<p>Repr\u00e9sent\u00e9e par Maxi Pesch, g\u00e9rante<\/p>\n\n\n\n<p>Les pr\u00e9sentes Conditions G\u00e9n\u00e9rales r\u00e9gissent les prestations propos\u00e9es par <strong>1000Deeg S\u00e0rl-S<\/strong>, soci\u00e9t\u00e9 \u00e9tablie au Grand-Duch\u00e9 de Luxembourg, dans le cadre d\u2019un accompagnement personnalis\u00e9 en nutrition infantile et diversification alimentaire.<\/p>\n\n\n\n<p><strong>2. Objet des prestations<\/strong><\/p>\n\n\n\n<p>Les prestations propos\u00e9es par 1000Deeg S\u00e0rl-S consistent en un <strong>accompagnement \u00e9ducatif, informatif et nutritionnel personnalis\u00e9<\/strong>, notamment dans le cadre :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>de la diversification alimentaire ;<\/li>\n\n\n\n<li>de l\u2019introduction des allerg\u00e8nes ;<\/li>\n\n\n\n<li>de l\u2019analyse des habitudes alimentaires de l\u2019enfant ;<\/li>\n\n\n\n<li>de l\u2019inconfort digestif ;<\/li>\n\n\n\n<li>de la peau sensible, de l\u2019ecz\u00e9ma dans son contexte nutritionnel et de r\u00e9actions alimentaires suspect\u00e9es ;<\/li>\n\n\n\n<li>de recommandations pratiques, protocoles d\u2019accompagnement, id\u00e9es de repas, recettes et pistes de soutien nutritionnel.<\/li>\n<\/ul>\n\n\n\n<p><br>Selon l\u2019offre choisie, l\u2019accompagnement peut comprendre :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>un questionnaire de sant\u00e9 ;<\/li>\n\n\n\n<li>un journal alimentaire ;<\/li>\n\n\n\n<li>une consultation individuelle ;<\/li>\n\n\n\n<li>un protocole ou plan d\u2019accompagnement personnalis\u00e9 ;<\/li>\n\n\n\n<li>un suivi via WhatsApp ;<\/li>\n\n\n\n<li>un ou plusieurs appels de suivi<\/li>\n<\/ul>\n\n\n\n<p><strong>3. <\/strong><strong>Nature de l\u2019accompagnement<\/strong><\/p>\n\n\n\n<p>Les conseils, informations et recommandations fournis par 1000Deeg S\u00e0rl-S sont <strong>strictement d\u2019ordre \u00e9ducatif, informatif et nutritionnel<\/strong>.<\/p>\n\n\n\n<p><br>Ils ne constituent :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>ni un acte m\u00e9dical ;<\/li>\n\n\n\n<li>ni un diagnostic ;<\/li>\n\n\n\n<li>ni une prescription ;<\/li>\n\n\n\n<li>ni un traitement ;<\/li>\n\n\n\n<li>ni une interpr\u00e9tation d\u2019analyses m\u00e9dicales ;<\/li>\n\n\n\n<li>ni une modification d\u2019un traitement en cours.<\/li>\n<\/ul>\n\n\n\n<p><br>L\u2019accompagnement propos\u00e9 ne remplace en aucun cas un suivi par un m\u00e9decin, p\u00e9diatre, allergologue ou tout autre professionnel de sant\u00e9 habilit\u00e9.<\/p>\n\n\n\n<p><strong>4. <\/strong><strong>Obligations du client<\/strong><\/p>\n\n\n\n<p>Le client s\u2019engage \u00e0 fournir des informations exactes, compl\u00e8tes et sinc\u00e8res concernant la sant\u00e9 de l\u2019enfant, son alimentation, ses ant\u00e9c\u00e9dents, ses r\u00e9actions \u00e9ventuelles et tout \u00e9l\u00e9ment utile \u00e0 l\u2019accompagnement.<\/p>\n\n\n\n<p><br>Le client demeure pleinement responsable :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>de la mise en pratique des recommandations ;<\/li>\n\n\n\n<li>du choix des aliments ;<\/li>\n\n\n\n<li>de la pr\u00e9paration des repas ;<\/li>\n\n\n\n<li>de la s\u00e9curit\u00e9 de l\u2019enfant, notamment concernant les textures adapt\u00e9es, la surveillance pendant les repas et la pr\u00e9vention du risque d\u2019\u00e9touffement.<\/li>\n<\/ul>\n\n\n\n<p><br>En cas de doute m\u00e9dical, d\u2019allergie suspect\u00e9e ou av\u00e9r\u00e9e, de sympt\u00f4me inhabituel, de r\u00e9action s\u00e9v\u00e8re ou de tout probl\u00e8me de sant\u00e9, le client s\u2019engage \u00e0 consulter sans d\u00e9lai un professionnel de sant\u00e9 comp\u00e9tent.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>5. Modalit\u00e9s d\u2019accompagnement<\/strong><\/h3>\n\n\n\n<h3 class=\"wp-block-heading\"><br>L\u2019accompagnement d\u00e9bute apr\u00e8s validation de l\u2019offre choisie par le client et r\u00e9ception, le cas \u00e9ch\u00e9ant, des documents pr\u00e9paratoires demand\u00e9s.<\/h3>\n\n\n\n<p><br>Dans le cadre d\u2019un accompagnement avec suivi, le client reconna\u00eet que :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>les \u00e9changes WhatsApp ont lieu pendant la dur\u00e9e pr\u00e9vue dans l\u2019offre choisie ;<\/li>\n\n\n\n<li>les r\u00e9ponses sont apport\u00e9es dans un d\u00e9lai raisonnable, hors urgence m\u00e9dicale ;<\/li>\n\n\n\n<li>le suivi ne constitue pas un service d\u2019urgence ni une permanence m\u00e9dicale.<\/li>\n<\/ul>\n\n\n\n<p><strong>6. Honoraires et paiement<\/strong><\/p>\n\n\n\n<p>Les honoraires sont pr\u00e9cis\u00e9s dans la convention ou l\u2019offre accept\u00e9e par le client.<\/p>\n\n\n\n<p>Sauf mention contraire, les prestations d\u00e9butent apr\u00e8s r\u00e9ception du paiement.<\/p>\n\n\n\n<p>Conform\u00e9ment au r\u00e9gime de franchise TVA applicable, les prestations sont factur\u00e9es sans TVA.Mention : \u00ab Exon\u00e9r\u00e9 de TVA \u2013 r\u00e9gime de franchise des petites entreprises. \u00bb<\/p>\n\n\n\n<p><strong>7. Droit de r\u00e9tractation<\/strong><\/p>\n\n\n\n<p><br>Conform\u00e9ment aux dispositions applicables en mati\u00e8re de contrats \u00e0 distance, le client consommateur dispose, en principe, d\u2019un droit de r\u00e9tractation de 14 jours calendrier \u00e0 compter de la conclusion du contrat.<\/p>\n\n\n\n<p>Si le client demande express\u00e9ment que l\u2019ex\u00e9cution de la prestation commence avant l\u2019expiration de ce d\u00e9lai, il reconna\u00eet que, lorsque la prestation aura \u00e9t\u00e9 pleinement ex\u00e9cut\u00e9e, il perdra son droit de r\u00e9tractation, conform\u00e9ment aux dispositions l\u00e9gales applicables.<\/p>\n\n\n\n<p>En cas de r\u00e9tractation apr\u00e8s le d\u00e9but d\u2019ex\u00e9cution demand\u00e9 express\u00e9ment par le client, un montant proportionnel aux prestations d\u00e9j\u00e0 ex\u00e9cut\u00e9es pourra \u00eatre d\u00fb, dans les limites pr\u00e9vues par la loi.<\/p>\n\n\n\n<p><strong>8<\/strong><strong>. <\/strong><strong>Annulation, report et interruption<\/strong><\/p>\n\n\n\n<p>Toute demande d\u2019annulation ou de report d\u2019un rendez-vous doit \u00eatre communiqu\u00e9e dans un d\u00e9lai raisonnable.<\/p>\n\n\n\n<p><br>Sauf accord contraire :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>une consultation annul\u00e9e moins de 24 heures \u00e0 l\u2019avance peut \u00eatre consid\u00e9r\u00e9e comme due ;<\/li>\n\n\n\n<li>en cas d\u2019absence du client au rendez-vous, la s\u00e9ance est consid\u00e9r\u00e9e comme r\u00e9alis\u00e9e ;<\/li>\n\n\n\n<li>tout accompagnement entam\u00e9 ne peut donner lieu \u00e0 un remboursement int\u00e9gral.<\/li>\n<\/ul>\n\n\n\n<p><br>Si le client interrompt volontairement un accompagnement en cours, les sommes d\u00e9j\u00e0 vers\u00e9es restent acquises \u00e0 1000Deeg S\u00e0rl-S pour les prestations d\u00e9j\u00e0 pr\u00e9par\u00e9es ou ex\u00e9cut\u00e9es.<\/p>\n\n\n\n<p><strong>9<\/strong><strong>. <\/strong><strong>Disclaimer<\/strong><\/p>\n\n\n\n<p>1000Deeg S\u00e0rl-S met en \u0153uvre ses prestations avec s\u00e9rieux, diligence et bonne foi, dans le cadre d\u2019une obligation de moyens.<\/p>\n\n\n\n<p><br>Le client reconna\u00eet que les recommandations fournies ne garantissent pas un r\u00e9sultat d\u00e9termin\u00e9, notamment en mati\u00e8re de digestion, de r\u00e9actions alimentaires, de peau sensible ou d\u2019\u00e9volution d\u2019un ecz\u00e9ma.<\/p>\n\n\n\n<p><br><strong>Sauf disposition l\u00e9gale imp\u00e9rative contraire<\/strong>, la responsabilit\u00e9 de 1000Deeg S\u00e0rl-S est limit\u00e9e aux dommages directs r\u00e9sultant d\u2019une faute prouv\u00e9e dans l\u2019ex\u00e9cution de la prestation. Elle est exclue pour les dommages indirects, immat\u00e9riels, cons\u00e9cutifs ou r\u00e9sultant d\u2019une mauvaise utilisation des recommandations par le client.<\/p>\n\n\n\n<p><br>Cette limitation ne s\u2019applique pas en cas de faute lourde ou dolosive, ni dans les cas o\u00f9 la loi interdit toute limitation ou exclusion de responsabilit\u00e9. Les clauses abusives dans les contrats avec les consommateurs peuvent \u00eatre \u00e9cart\u00e9es par le droit luxembourgeois, donc cette r\u00e9daction prudente est pr\u00e9f\u00e9rable \u00e0 une exclusion trop large.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>10. Confidentialit\u00e9<\/strong><\/h3>\n\n\n\n<p><br>1000Deeg S\u00e0rl-S s\u2019engage \u00e0 traiter de mani\u00e8re confidentielle les informations communiqu\u00e9es par le client dans le cadre de l\u2019accompagnement, sous r\u00e9serve :<\/p>\n\n\n\n<ul class=\"wp-block-list\">\n<li>des obligations l\u00e9gales applicables ;<\/li>\n\n\n\n<li>de la n\u00e9cessit\u00e9 de se d\u00e9fendre en justice ;<\/li>\n\n\n\n<li>ou de l\u2019accord expr\u00e8s du client.<\/li>\n<\/ul>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>11. Propri\u00e9t\u00e9 intellectuelle<\/strong><\/h3>\n\n\n\n<p><br>Tous les documents, supports, protocoles, questionnaires, plans, fiches, contenus \u00e9crits, recettes et outils transmis au client dans le cadre de l\u2019accompagnement restent la propri\u00e9t\u00e9 exclusive de 1000Deeg S\u00e0rl-S.<br>Ils sont r\u00e9serv\u00e9s \u00e0 un usage strictement personnel et ne peuvent \u00eatre reproduits, partag\u00e9s, diffus\u00e9s, vendus ou exploit\u00e9s sans autorisation \u00e9crite pr\u00e9alable.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>12. Litiges et m\u00e9diation<\/strong><\/h3>\n\n\n\n<h3 class=\"wp-block-heading\"><br>En cas de difficult\u00e9, le client est invit\u00e9 \u00e0 contacter en priorit\u00e9 1000Deeg S\u00e0rl-S afin de rechercher une solution amiable.<\/h3>\n\n\n\n<p><br>En cas de litige entre un professionnel et un consommateur, le recours \u00e0 la <strong>m\u00e9diation de la consommation<\/strong> peut \u00e9galement \u00eatre envisag\u00e9. Au Luxembourg, le M\u00e9diateur de la consommation peut aider \u00e0 rechercher une solution amiable<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"><strong>13. Identification of the service provider<\/h2>\n\n\n\n<p>1000Deeg S\u00e0rl-S<br>Registered office: 5, rue Renert, 7223 Bereldange<br>RCS Luxembourg: B288457<br>Represented by Maxi Pesch, managing director<\/p>\n\n\n\n<p>These General Terms and Conditions govern the services offered by 1000Deeg S\u00e0rl-S, a company established in the Grand Duchy of Luxembourg, in the context of personalised baby nutrition and complementary feeding accompaniment.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">2. Scope of services<\/h2>\n\n\n\n<p>The services offered by 1000Deeg S\u00e0rl-S consist of personalised educational, informational and nutritional accompaniment, particularly in the context of:<\/p>\n\n\n\n<p>\u2014 Complementary feeding (starting solids)<br>\u2014 Allergen introduction<br>\u2014 Analysis of the child&#8217;s eating habits<br>\u2014 Digestive discomfort<br>\u2014 Sensitive skin, eczema in its nutritional context and suspected food reactions<br>\u2014 Practical recommendations, accompaniment protocols, meal ideas, recipes and nutritional support suggestions<\/p>\n\n\n\n<p>Depending on the package chosen, the accompaniment may include:<\/p>\n\n\n\n<p>\u2014 A health questionnaire<br>\u2014 A food diary<br>\u2014 An individual consultation<br>\u2014 A personalised accompaniment protocol or plan<br>\u2014 Follow-up via WhatsApp<br>\u2014 One or more follow-up calls<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">3. Nature of the accompaniment<\/h2>\n\n\n\n<p>The advice, information and recommendations provided by 1000Deeg S\u00e0rl-S are strictly educational, informational and nutritional in nature.<\/p>\n\n\n\n<p>They do not constitute:<\/p>\n\n\n\n<p>\u2014 A medical act<br>\u2014 A diagnosis<br>\u2014 A prescription<br>\u2014 A treatment<br>\u2014 An interpretation of medical test results<br>\u2014 A modification of an ongoing treatment<\/p>\n\n\n\n<p>The accompaniment offered does not in any way replace medical supervision by a doctor, paediatrician, allergist or any other qualified healthcare professional.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">4. Client obligations<\/h2>\n\n\n\n<p>The client undertakes to provide accurate, complete and honest information regarding the child&#8217;s health, diet, medical history, any reactions and any other information relevant to the accompaniment.<\/p>\n\n\n\n<p>The client remains fully responsible for:<\/p>\n\n\n\n<p>\u2014 Implementing the recommendations in practice<br>\u2014 Food choices<br>\u2014 Meal preparation<br>\u2014 The child&#8217;s safety, particularly with regard to age-appropriate textures, supervision during meals and choking prevention<\/p>\n\n\n\n<p>In the event of medical doubt, a suspected or confirmed allergy, unusual symptoms, a severe reaction or any health concern, the client undertakes to consult a qualified healthcare professional without delay.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">5. Terms of accompaniment<\/h2>\n\n\n\n<p>The accompaniment begins after the client has confirmed their chosen package and, where applicable, submitted the requested preparatory documents.<\/p>\n\n\n\n<p>In the context of accompaniment with follow-up support, the client acknowledges that:<\/p>\n\n\n\n<p>\u2014 WhatsApp exchanges take place during the period specified in the chosen package<br>\u2014 Responses are provided within a reasonable timeframe, excluding medical emergencies<br>\u2014 The follow-up does not constitute an emergency service or medical helpline<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">6. Fees and payment<\/h2>\n\n\n\n<p>Fees are specified in the agreement or package accepted by the client.<\/p>\n\n\n\n<p>Unless otherwise stated, services begin after payment has been received.<\/p>\n\n\n\n<p>In accordance with the applicable VAT exemption regime, services are invoiced without VAT. Note: &#8220;VAT exempt \u2014 small business exemption scheme.&#8221;<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">7. Right of withdrawal<\/h2>\n\n\n\n<p>In accordance with applicable provisions on distance contracts, the consumer client has, in principle, a right of withdrawal of 14 calendar days from the date of conclusion of the contract.<\/p>\n\n\n\n<p>If the client expressly requests that the service begins before the expiry of this period, they acknowledge that once the service has been fully performed, they will lose their right of withdrawal, in accordance with applicable legal provisions.<\/p>\n\n\n\n<p>In the event of withdrawal after the commencement of services expressly requested by the client, an amount proportional to the services already provided may be due, within the limits provided by law.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">8. Cancellation, rescheduling and interruption<\/h2>\n\n\n\n<p>Any cancellation or rescheduling request must be communicated within a reasonable timeframe.<\/p>\n\n\n\n<p>Unless otherwise agreed:<\/p>\n\n\n\n<p>\u2014 A consultation cancelled less than 24 hours in advance may be charged in full<br>\u2014 In the event of a no-show, the session is considered completed<br>\u2014 Any accompaniment that has already begun cannot be fully refunded<\/p>\n\n\n\n<p>If the client voluntarily interrupts an ongoing accompaniment, any fees already paid remain with 1000Deeg S\u00e0rl-S for services already prepared or delivered.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">9. Liability<\/h2>\n\n\n\n<p>1000Deeg S\u00e0rl-S delivers its services with care, diligence and good faith, within the framework of a best-efforts obligation.<\/p>\n\n\n\n<p>The client acknowledges that the recommendations provided do not guarantee a specific outcome, particularly in relation to digestion, food reactions, sensitive skin or the progression of eczema.<\/p>\n\n\n\n<p>Unless otherwise required by mandatory legal provisions, the liability of 1000Deeg S\u00e0rl-S is limited to direct damages resulting from a proven fault in the delivery of the service. Liability is excluded for indirect, immaterial, consequential damages or damages resulting from the client&#8217;s misuse of the recommendations.<\/p>\n\n\n\n<p>This limitation does not apply in cases of gross negligence or wilful misconduct, nor in cases where the law prohibits any limitation or exclusion of liability. Clauses deemed unfair in consumer contracts may be set aside under Luxembourg law; this wording is therefore preferred over a broader exclusion.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">10. Confidentiality<\/h2>\n\n\n\n<p>1000Deeg S\u00e0rl-S undertakes to treat all information shared by the client in the context of the accompaniment as confidential, subject to:<\/p>\n\n\n\n<p>\u2014 Applicable legal obligations<br>\u2014 The need to defend itself in legal proceedings<br>\u2014 The express consent of the client<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">11. Intellectual property<\/h2>\n\n\n\n<p>All documents, materials, protocols, questionnaires, plans, guides, written content, recipes and tools provided to the client as part of the accompaniment remain the exclusive property of 1000Deeg S\u00e0rl-S. They are intended for strictly personal use and may not be reproduced, shared, distributed, sold or exploited without prior written consent.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">12. Disputes and mediation<\/h2>\n\n\n\n<p>In the event of a difficulty, the client is encouraged to contact 1000Deeg S\u00e0rl-S first in order to seek an amicable resolution.<\/p>\n\n\n\n<p>In the event of a dispute between a professional and a consumer, consumer mediation may also be considered. In Luxembourg, the Consumer Mediator can assist in finding an amicable solution.<\/p>\n\n\n\n<h2 class=\"wp-block-heading\">13.
